Overview
Welcome to Slime Design.
The terms “we”, “us” and “our” refer to Slime Design. Slime Design operates this online store and website, including the related information, content, features, tools, products and services made available through it (collectively, the “Services”).
Slime Design is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with the policies referenced in them, describe the terms that apply when you access or use our Services or purchase products from us.
Please read these Terms carefully. By accessing or using our Services or placing an order, you agree to these Terms and our Privacy Policy.
Nothing in these Terms is intended to exclude, restrict or waive any right or remedy that cannot lawfully be excluded under applicable South African law, including the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).
Where applicable law provides you with rights that are more favourable than these Terms, your statutory rights will apply.
1. Access and Accounts
A person placing an order must be at least 18 years old or otherwise legally capable of entering into the transaction.
Where products are purchased for or used by a child, the purchase should be made or supervised by a parent or legal guardian.
You may be asked to provide information such as your name, email address, billing information, payment information and delivery information when using the Services.
You agree that information you provide to us will be accurate, current and complete and that you have the right to provide that information.
If you create a customer account, you are responsible for taking reasonable steps to protect your account credentials and for activity carried out through your account.
You may not sell, transfer or provide your customer account to another person for unauthorised use.
2. Our Products
We make reasonable efforts to describe and display our products accurately.
Because Slime Design products are handmade, reasonable variations may occur between individual products and batches. These may include minor variations in colour, decoration, sprinkle placement, charms, clay-piece details and other handmade elements.
Product colours and appearance may also differ slightly from what you see on your screen because of photography, lighting, screen settings and device configuration.
These reasonable variations do not permit us to supply a product that is materially different from what was advertised or ordered and do not limit any statutory rights you may have.
We may change or discontinue products and may limit quantities or availability where reasonably necessary.
Product availability is subject to stock availability.
3. Product Safety and Use
Slime is a sensory play product and must not be eaten or consumed.
Products should be used according to the safety, care and usage information supplied or made available by Slime Design.
Children should be appropriately supervised during slime play.
Some products may contain charms, sprinkles, clay pieces or other small components that may present a choking hazard. Products containing small parts must be kept away from very young children and anyone likely to place the product or its components in their mouth.
Avoid contact with eyes, mouth, broken skin and other sensitive areas. Washing hands before and after slime play is recommended.
If skin irritation or discomfort occurs while using slime, stop using it and wash the affected area with clean water. Do not continue using a product that causes irritation. Seek appropriate medical advice if symptoms are significant or persist.
Customers should consider known sensitivities and review available product and safety information before use.
These safety instructions do not exclude or limit any rights or remedies relating to unsafe or defective products under applicable South African law.
4. Slime Care and Product Lifespan
Slime is a handmade sensory product whose consistency can naturally change because of temperature, weather, storage, age and use.
For example, slime may become sticky or softer in warm conditions and may require a small amount of activator or Sticky-Stop. Over time and with use, slime may shrink, become firmer, dry out or otherwise change in consistency.
Customers should follow the care and storage guidance supplied or made available with our products and use activator or Sticky-Stop appropriately.
Normal ageing and changes caused by temperature, storage, use or improper care are not automatically product defects.
Nothing in this section will be used to deny a legitimate claim relating to defective or unsafe goods or otherwise limit statutory consumer rights.
5. Orders
When you submit an order, you are making an offer to purchase the selected products.
An order may be declined or cancelled where there is a lawful and reasonable reason to do so, including:

an inventory or stock error;

suspected fraud or unauthorised payment activity;

an obvious pricing or listing error;
-
inability to deliver to the supplied address;
-
inability to fulfil the order;
-
quantities or circumstances reasonably indicating unauthorised commercial resale; or
-
another legitimate reason that prevents us from processing or fulfilling the order.
Where reasonably possible, we will contact you using the contact information supplied with your order if an issue affects your order.
If Slime Design cancels an order after payment has been received, we will refund the appropriate amount paid for the cancelled item or order, together with applicable delivery charges where appropriate.
Please review your order carefully before submitting it.
If you realise that you have made a mistake, contact us as soon as possible. We will try to accommodate order changes or cancellation requests before fulfilment where reasonably possible, but cannot guarantee that changes can be made once processing or packing has begun.
Any statutory cancellation rights remain unaffected.
Returns, refunds and cancellations are also subject to our Return & Refund Policy.
6. Personal Use and Resale
Products purchased through our retail store are intended for personal or household use, including purchases made as gifts.
You may not purchase Slime Design products for commercial resale unless you have been specifically authorised by Slime Design to do so.
Nothing in this section prevents Slime Design from establishing authorised reseller, wholesale or stockist arrangements separately.
7. Prices, VAT and Payment
Prices displayed for products are in South African Rand (ZAR) unless otherwise stated and include VAT where applicable.
Delivery charges and any other applicable charges will be disclosed before you complete your purchase.
Prices, promotions and product availability may change from time to time. The price applicable to your purchase will ordinarily be the price displayed and agreed when your order is placed, subject to the provisions below relating to genuine errors.
Payments are processed through the payment methods and payment providers made available at checkout.
You agree to provide accurate payment information and confirm that you are authorised to use the payment method selected.
An order may be delayed, declined or cancelled where payment cannot be authorised or where there are reasonable fraud or security concerns.
Payment-card information may be processed by Shopify and/or the relevant payment provider. Our handling of personal information is further described in our Privacy Policy.
8. Pricing and Listing Errors
We take reasonable care to ensure that product descriptions, prices, promotions, availability and other information displayed through the Services are accurate.
Occasionally, genuine errors may occur.
If we identify an obvious or material pricing, product-information or promotional error, we may correct the information and, where appropriate, contact you before fulfilling the affected order.
Where we cannot reasonably honour an order because of a genuine material error, we may cancel the affected item or order and refund any amount already paid for it.
We will not charge you a higher corrected price without your agreement.
Nothing in this section limits any rights you may have under applicable South African law.
9. Promotions and Discount Codes
We may offer promotions, discount codes, special offers or other promotional arrangements from time to time.
Individual promotions may have additional conditions, such as:

start and end dates;

minimum purchase requirements;
-
eligible or excluded products;
-
limits on the number of uses;
-
one use per customer;
-
limited stock; or
-
restrictions on combining promotions or discount codes.
Any material conditions applicable to a promotion will be communicated with the relevant offer.
Promotional terms do not remove or reduce statutory consumer rights.
10. Shipping and Delivery
Delivery timeframes provided through our store are estimates unless expressly stated otherwise.
We will make reasonable efforts to fulfil and dispatch orders within the timeframes communicated to customers.
Delays may occasionally occur because of courier disruptions, weather, infrastructure problems or other circumstances outside our reasonable control.
Handing a parcel to a courier does not automatically remove any responsibility Slime Design has under applicable South African law.
Where a parcel is lost, incorrectly delivered, damaged or disputed, the circumstances will be investigated and dealt with in accordance with applicable law and our Shipping and Return & Refund Policies.
Customers are responsible for supplying complete and accurate delivery information.
Where an incorrect or incomplete address supplied by the customer causes a parcel to be returned to Slime Design, the customer may be responsible for the reasonable cost of resending it.
Where a courier correctly delivers an order to an incorrect address supplied by the customer and the parcel cannot be recovered, Slime Design will not be responsible for providing a replacement at our cost.
This does not apply where the delivery error was caused by Slime Design or the courier.
11. Events Outside Our Reasonable Control
We will not be responsible for a delay or failure caused by circumstances genuinely outside our reasonable control, such as severe weather, natural disasters, major courier or transport disruptions, significant power or telecommunications failures, civil emergencies, government restrictions or similar events.
Where such an event affects an order, we may reasonably extend the fulfilment timeframe and will endeavour to keep affected customers appropriately informed.
This section does not give us an unlimited right to retain payment without supplying an order and does not override cancellation, refund or other rights available under applicable South African law.
12. Intellectual Property
The Slime Design website and its original content—including our brand elements, logos, product photography, graphics, videos, written content, product descriptions, designs and other original creative materials—are owned by or licensed to Slime Design and are protected by applicable intellectual-property laws.
Except where permitted by law or expressly authorised by us, you may not reproduce, copy, distribute, republish, commercially exploit, modify or create derivative works from our protected content without prior permission.
Nothing in these Terms transfers ownership of Slime Design intellectual property to you.
Shopify's name, trademarks and other intellectual property remain the property of Shopify or its applicable rights holders.
Other third-party names, trademarks, content and intellectual property remain the property of their respective owners.
13. Optional Third-Party Tools and Services
The Services may provide access to tools, functionality or services supplied by third parties.
Third-party services may be subject to their own terms, policies and privacy practices.
While we do not control independent third-party services or websites, nothing in these Terms excludes responsibility that Slime Design is legally required to bear in connection with your transaction or use of the Services.
You should review relevant third-party terms and policies where appropriate.
14. Third-Party Links
Our Services may contain links to third-party websites or online platforms.
We do not control independent third-party websites and cannot guarantee the accuracy, availability, security or content of those websites.
If you choose to visit or transact through an independent third-party website, its own terms and privacy practices may apply.
Nothing in this section excludes or limits responsibility that cannot lawfully be excluded under applicable South African law.
15. Relationship with Shopify
Slime Design is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Slime Design.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Slime Design, including any injury, damage, or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Slime Design.
16. Privacy
Personal information collected through the Services is processed in accordance with our Privacy Policy and applicable data-protection law.
Because our Services are hosted by Shopify, Shopify also collects and processes certain personal information relating to access to and use of the Services in order to provide and improve Shopify-powered services.
Information may also be processed by Shopify and relevant service providers in countries outside South Africa, as further explained in our Privacy Policy.
Please review our Privacy Policy for more information about how personal information is collected, used, disclosed and protected and how you may exercise applicable privacy rights.
17. Reviews, Feedback and User-Submitted Content
If you voluntarily submit a review, photograph, comment, suggestion, feedback or other content to Slime Design, you retain ownership of your original content.
By submitting content for publication or use in connection with Slime Design, you grant us a non-exclusive, royalty-free permission to reproduce, display, publish and use that content reasonably in connection with our business, Services and marketing.
You confirm that you have the necessary rights to submit the content and that its use as permitted by these Terms will not unlawfully infringe another person's rights.
Where you received compensation, a free product or another incentive in connection with submitted content, you must disclose that where required.
We may moderate, decline to publish or remove content that is unlawful, fraudulent, misleading, abusive, defamatory, obscene, infringes another person's rights, contains malicious software or is otherwise inappropriate for our Services.
Our processing of personal information contained in submitted content remains subject to applicable privacy law and our Privacy Policy.
18. Prohibited Uses
You may use the Services only for lawful purposes.
You must not use the Services to:

engage in unlawful, fraudulent or malicious conduct;

infringe Slime Design's or another person's intellectual-property or other legal rights;

harass, threaten, abuse or unlawfully harm another person;

transmit knowingly false, fraudulent or misleading information;

distribute malware, viruses or malicious code;

attempt to gain unauthorised access to accounts, systems or data;

interfere with the security or normal operation of the Services;

collect or track another person's personal information unlawfully;

send spam or other unlawful unsolicited communications;
-
impersonate another person or entity;
-
scrape, extract, reproduce or commercially exploit website content without authorisation where such activity is not permitted by law; or
-
circumvent security, access controls, robot-exclusion measures or other reasonable technical protections.
We may use reasonable technical measures to prevent unauthorised automated access, scraping or misuse of the Services.
19. Automated Agents
Where software, automated tools or artificial-intelligence agents access or interact with the Services, such access must comply with applicable law, these Terms and any reasonable technical requirements or access controls implemented by Slime Design or Shopify.
Automated systems must not conceal their automated nature where identification is reasonably required, circumvent security measures or CAPTCHAs, bypass restrictions designed to control automated access, or scrape or extract protected content without authorisation.
We may restrict or block automated access where reasonably necessary to protect the Services, customers, data, intellectual property or security.
This section does not prohibit automated functionality expressly authorised by Slime Design or Shopify.
20. Account Restriction and Termination
We may reasonably restrict, suspend or terminate access to an account or the Services where necessary because of suspected fraud, unlawful activity, abusive behaviour, security threats, misuse of the Services, repeated material breaches of these Terms or another legitimate reason.
Where appropriate and reasonably possible, we may notify the affected user.
Suspension or termination of website or account access does not remove rights or obligations relating to an existing transaction and does not affect statutory consumer rights.
Provisions of these Terms that by their nature should continue after termination will remain effective.
21. Product Warranties and Consumer Rights
Slime Design does not guarantee that every product will satisfy a customer's subjective preferences regarding matters such as scent, colour, texture or sensory feel.
Handmade variation and normal slime behaviour are addressed elsewhere in these Terms and in our Return & Refund Policy.
However, nothing in these Terms excludes, restricts or replaces warranties, guarantees, rights or remedies that apply under the CPA or other applicable South African law.
Where goods are defective, unsafe, unsuitable or otherwise fail to meet legally required standards, customers retain the rights and remedies provided by applicable law.
22. Limitation of Liability
To the extent permitted by applicable law, Slime Design will not be responsible for loss or damage caused by a customer's misuse of a product, failure to follow reasonable safety or care instructions, unauthorised alteration or contamination of a product, improper storage, or other conduct for which Slime Design is not legally responsible.
We do not exclude or limit liability where doing so would be unlawful.
In particular, nothing in these Terms is intended to exclude or limit statutory consumer rights or any liability or remedy relating to unsafe, defective or incorrectly supplied goods where such liability or remedy cannot lawfully be excluded.
Any limitation or exclusion in these Terms applies only to the fullest extent permitted by applicable South African law.
23. Indemnification
To the extent permitted by applicable law, you agree to be responsible for third-party claims, losses or reasonable costs arising directly from your unlawful conduct, infringement of another person's rights, unauthorised misuse of the Services or material breach of these Terms.
This provision does not require you to indemnify Slime Design for our own unlawful conduct, negligence, defective products, statutory obligations or any matter for which liability cannot lawfully be transferred to you.
24. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be applied to the fullest extent permitted by law or, where necessary, severed.
The remaining provisions will continue to apply to the extent legally possible.
25. Waiver and Entire Agreement
If we do not immediately exercise or enforce a right under these Terms, that does not mean that we have waived that right.
These Terms, together with the policies and other terms expressly incorporated into them, constitute the agreement governing your use of the Services and purchases through the store, subject always to applicable law.
Nothing in this section excludes representations, disclosures or consumer rights that cannot lawfully be excluded.
26. Assignment
You may not transfer your rights or obligations under these Terms in a manner that would unlawfully affect Slime Design or another person without our consent.
Slime Design may transfer rights or obligations relating to the business where legally permitted, including as part of a legitimate transfer or restructuring of the business.
Any assignment remains subject to applicable law and does not remove existing consumer rights.
27. Governing Law and Disputes
These Terms and transactions made through the Slime Design store are governed by the laws of the Republic of South Africa.
Nothing in these Terms prevents a consumer from exercising any right to approach an appropriate court, regulator, consumer body, ombud, tribunal or other dispute-resolution forum available under applicable South African law.

Section headings are included for convenience and do not change the meaning or interpretation of these Terms.
29. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, Services, Shopify functionality, policies or applicable law.
The latest version will be made available through our website and the “Last updated” date may be revised accordingly.
Where required by law, we will provide appropriate notice of material changes.
Changes to these Terms will not retrospectively alter the agreed terms applicable to a purchase already completed, except where applicable law requires otherwise.

31. Statutory Rights
Nothing in these Terms of Service is intended to exclude, restrict, waive or replace any right, remedy, guarantee or protection that cannot lawfully be excluded under South African law.
Where applicable legislation—including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, and applicable privacy and other consumer-protection legislation—provides you with rights that conflict with or are more favourable than these Terms, the applicable statutory provisions will prevail.
